Art. 50(2) labelling of AI images

All

⚖️ Not legal advice. Plain-language summary; what is binding are evanto’s legal documents and the applicable version of the AI Act.

The AI Act requires that AI-generated content be recognizable as such. This affects CompanyWizard’s image generator on two levels: the technical labeling by evanto (as the provider) and your disclosure on publication (as the deployer).

What evanto takes care of (provider obligation, Art. 50(2))

Section titled “What evanto takes care of (provider obligation, Art. 50(2))”

CompanyWizard marks images produced in the image generator as AI-generated in a machine-readable technical form (metadata/watermark, in the direction of C2PA). Under the current legal status, this provider obligation takes effect from 02.12.2026 (deadline postponed by the Digital Omnibus from 02.08.2026; not yet finally in force). In the image generator itself, both the original and the optimized prompt are also shown transparently. → Image generator

Where such signed Content Credentials (C2PA provenance) are present in a generated image, the image generator shows them in the gallery detail view → Content Credentials (C2PA).

What you take care of (deployer obligation, Art. 50(4))

Section titled “What you take care of (deployer obligation, Art. 50(4))”

If you publish AI-generated or AI-altered images/media (“deepfakes”) — or AI-generated texts on matters of public interest — you must disclose this. The technical marking of the file does not release you from visible labeling in the publication context.

The image generator must not be used for content prohibited under the AI Act (including non-consensual intimate content, CSAM). → EU AI Act: notes for deployers

The Digital Omnibus on AI (political agreement May 2026) is not yet in force as of this draft; the deadline named above may shift. What governs is the version in force.
